Heard rival submissions 2.

There is a consensus between learned counsel for rival parties for transferring all the litigations between the parties to the concerned courts at Aurangabad. Both the learned counsel made submission to that effect after taking instructions of their respective clients. In view of the same, following order is passed.

ORDER

(i) The application is hereby allowed.

(ii) The HMP No.387 of 2022 pending in the court of CJSD, Niphad, District Nashik is transferred to the Court of CJSD, Aurangabad for disposal according to law.

(iii) Likewise, the RCC No.503 of 2022 fled at the instance of applicant before learned JMFC, Paithan and the PWDVA Case No.5 of 2023 fled by the applicant before the same court, are

2 942 mca 258-22 transferred to the Court of Chief Judicial Magistrate, Aurangabad for disposal according to law. The Chief Judicial Magistrate, Aurangabad is at liberty to transfer these cases to the same Court of JMFC, Aurangabad.

(iv) Parties are directed to appear before the concerned court at Aurangabad 10/04/2023.

(v) The application is disposed of accordingly.
