Present application has been filed by the original claimant for getting the delay of 1155 days condoned in filing first appeal. The claimant intends to challenge the judgment and award passed by the learned reference Court.

Learned AGP representing respondent Nos.1 and 2 strongly opposes the application on the ground that whatever reasons have been given in the application are not sufficient and reasonable. Though respondent No.3 is served, nobody appears.

The applicant is an agriculturist, whose land has been acquired and he is coming from rural area. He has categorically stated that it took time for him to collect funds to prefer appeal and therefore, taking into consideration the said point, liberal approach is taken, delay stands condoned.

Civil Application stands allowed and disposed of accordingly. 5.

It is clarified that the applicant will not be entitled to get interest of 1155 days in case of success to his appeal. 6.

Registry to verify and register the first appeal and place it for further consideration on 20.11.2019.
