The petitioner has approached this Court challenging order dated 20.08.2025, issued by the respondent no.2Maharashtra Jeevan Pradhikaran. The petitioner alleges that by the impugned order, powers exercised by the petitioner as Chief Engineer of respondent no.2-MJP in the regional office of Chhatrapati Sambhaji Nagar have been withdrawn and this amounts colourable exercise of power as if violates specific mandate contained in paragraph no.2 of order dated 09.01.2025, passed by the Division Bench of this Court at the Principal Seat in Public Interest Litigation No.188 of 2022. 2.

Paragraph 2 of the aforesaid order reads as under:

At the outset, we have considered the submissions of the learned Amicus Curie as well as the Stake Holders and, therefore, to ensure continuity in the progress of this project, we direct that Mr Dilip Gawade, the Divisional Commissioner of Chhatrapati Sambhajinagar Region and Mrs. Manisha Palande, the Chief Engineer of the MJP, shall not be transferred from their present positions without the leave of the Court.

It is the case of the petitioner that if the respondent no.2 was to take any such steps, it ought to have sought leave of this Court. Attention of this Court is further invited to order dated 11.06.2025, particularly paragraph 11 thereof, whereby, the Division Bench at the Principal Seat in the aforesaid PIL, had specifically directed that a particular official shall remain disassociated with the project in question and that it would be appreciated that he does not return to the project. According to the petitioner, the impugned order dated 20.08.2025, clearly violates mandate of the said directions issued by this Court at the principal seat.

We are of the opinion that the grievance raised by the petitioner can be agitated before the principal seat in the said

pending PIL No.188 of 2022 and it may not be appropriate for this Bench to entertain this petition.

In this backdrop, the learned Counsel for the petitioner seeks permission to withdraw this petition, with liberty to approach the Division Bench at the Principal Seat of this Court in PIL No.188 of 2022, to seek appropriate directions in the matter.

In view of the above, the Writ Petition is disposed of as withdrawn, with liberty to the petitioner to approach the Division Bench of this Court at the Principal Seat in PIL No.188 of 2022 with regard to her grievance in respect of the order dated 20.08.2025, issued by respondent no.2-MJP. 7.
