Per Court :

Since these petitions are arising out of interim order passed by the learned Judicial Magistrate First Class, Renapur under the Domestic Violence Act, this Court feels that no purpose would be served by interfering with the interim order.

It is submitted that sister-in-law of petitioner no.2 and daughterin-law of petitioner no.1 is re-married on 14.02.2021. It is submitted that a fact be considered and liability of maintenance amount be restricted to the extent of sister-in-law till the date of re-marriage.

Learned Advocate for the respondent fairly conceded this position however submits that to the extent of daughter same order be continued.

Thus, liability to pay the amount to the extent of sister-in-law would be till the date of re-marriage i.e. 14.02.2021. However, to the extent of niece same shall be continued subject to outcome of the final proceeding.

Looking to the fact that the D.V. Proceeding is of the 2016, the petition is disposed off by directing the learned trial Court to decide the main proceeding pending before it within stipulated period. Hence the following order.

O R D E R

(i) The learned JMFC, Renapur is requested to dispose off the proceeding i.e. Criminal Miscellaneous Application No.54/2016 at the earliest and preferably within six months from today. (ii) The parties shall not seek unnecessary adjournment and shall cooperate to the Court in speedy disposal of the original proceeding.
