Heard the learned counsel for the applicant and the learned A.P.P. for the respondent.

The applicant seeks bail in C.R.No.0358 of 2024 registered with Ahmednagar Taluka Police Station, District Ahmednagar, for the offences punishable under Sections 302 and 504 read with Section 34 of the Indian Penal Code.

The prosecution has a case that the incident happened, as the deceased obstructed the applicant from going through the field. The applicant went to the field with co-accused and incident happened. His statement reveals that the present applicant barely hold the neck of the deceased. It was not the case of the prosecution that since the applicant hold the neck of the

915-BA-1623-24.odt deceased, other co-accused assaulted him. The applicant did not use the weapon. The investigation has been completed. Considering the nature of allegations levelled against the applicant and the completion of investigation, the Court is of the view that the applicant deserves bail. Hence, the order:-

ORDER

i) The application is allowed.

ii) Applicant - Bajrang Baburao Kakade be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution witnesses. (b) He should attend the trial on each and every effective dates.
