Heard the learned counsel for the parties.

In the appeal filed by the plaintiffs, which was dismissed for default, the plaintiff has preferred an application for restoration of the appeal. The said application is pending consideration. In the present matter this Court while issuing notice, had also granted status quo. However, the stay granted by this Court was not continued due to the default on the part of the petitioner.

Since there has been no execution till date, I deem it appropriate to direct the Appellate Court to decide the restoration application within a period of ten weeks from today. The status quo shall be maintained for a period of ten weeks from today.

The parties submit that they would cooperate with the Appellate Court in deciding the restoration application and would not seek adjournments. 5.

The petition is disposed of accordingly. All pending applications stand disposed of.
