Heard learned counsel for applicants and the learned AGP for respondent Nos. 1 and 2.

Learned AGP for respondent Nos. 1 & 2 has objected for condonation of delay.

According to the applicants, on account of poverty, they were unable to make arrangement for the payment of Court fee, as the applicants belong to a small village. The reasons assigned for delay are acceptable.

Thus, delay of 397 and 382 days is condoned subject to condition that applicants shall waive interest during the period of delay. Applicants shall file written undertaking to that effect in First Appeal within the period of eight weeks from the date of passing of this order.

Civil applications are disposed of.

First appeal (st) Nos. 28308 of 2017, 26509 of 2017 and 26557 of 2017 be registered.

Learned AGP waives service of notice for respondent nos.1 and 2.
