We have considered the submissions of the learned advocates for the respective sides.

The statutory authorities like the office of the Charity Commissioner, Maharashtra Mumbai is not relieving the petitioner, who actually is in the employment of the Zilla Parishad, Jalgaon as Gram Sevak and who was granted lien to join the office of the Charity Commissioner, Mumbai as Accountant. He desires to return to the parent organization and he was permitted by the Chief Executive Officer vide communication dated 14.06.2021 to report for duties on 21.06.2021. But for the fact that the Charity Commissioner declined to relieve the petitioner, that he was unable to join the Zilla Parishad at Jalgaon.

Till today, he is working as an Accountant with the office of the Assistant Charity Commissioner at Jalgaon. 4.

We appreciate the efforts put in by the learned advocate for the Zilla Parishad Mr. Sonawane, who has taken instructions and submits that in these peculiar facts of the case, the petitioner would be allowed to join his parent organisation after being relieved by the Charity Commissioner.

In view of the above, this petition is disposed off by directing respondent no.3 to relieve the petitioner on or before 18th April, 2022 at 11.00 a.m. so as to enable the petitioner to immediately report to the Zilla Parishad, Jalgaon by forenoon on the same day since he is at Jalgaon with the office of respondent no.4.

Needless to state, there shall be no break in service from the time of being relieved and the time he joins respondent no.2.
