The present application has been filed by wife seeking transfer of HMP No.244 of 2008 from the Court of the learned Joint Civil Judge, Senior Division, Buldhana to the learned Family Court at Aurangabad.

The notice in this application was issued on 07.10.2019. Thereafter, the application appeared on board on 06.12.2023, when none appeared for the parties. On 03.02.2025, a statement was made before this Court that the parties had already arrived at a compromise. However, the formality of filing detailed terms of settlement before the Family Court remained. On 10.03.2025, none appeared before the Court; therefore, this Court directed office to ascertain the status of the proceedings pending before the courts below. The office note shows that HMP
(( 2 )) 961-MCA-206-19 No.244 of 2008 is still pending before the learned Civil Judge, Senior Division, Buldhana. However, when the matter is called out today, none appears. Looking to the conduct of the parties, it is obvious that they have lost interest in prosecuting the present application. Hence, the Misllaneous Civil Application stands dismissed for want of prosecution.
