The petitioner is seeking appointment as Head Master on promotional post on the ground he is senior. He is relying upon communication of the Education Officer to suggest that even Arts teacher can be considered for promotion.

In view of the fact that, the petitioner claims to be superseded for the post of Head Master, the petitioner has remedy available under Section 9 of the Maharashtra Employees of Private Schools (Condition of Service Regulation) Act. 3.

The petitioner is at liberty avail the remedy available under the law. In that case all contentions of the parties are
