Heard the learned counsel for the applicant and the learned APP for the respondent-State.

It has been alleged against the applicant that he assaulted the injured with an iron rod on right hand arm, leg and head. The incident happened on 27.06.2022. The applicant has been arrested on 20.07.2022. Since then, he is behind the bar. The prosecution papers reveal that the injured has grievous injury on his right arm and leg. However, on head, there was a simple injury. The iron rod allegedly used in the crime has also been recovered at the instance of the applicant. The injured has been discharged from the hospital. In view of the facts and the material progress in the

919-BA.1616-22.odt investigation as well as considering the nature of the injury, it would be inappropriate to keep the applicant behind the bar for further period. The application deserves to be allowed. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) The applicant GORAKH MACCHINDRA KALE be released on bail on furnishing P.B. and S.B. of Rs.15,000/- (Rupees Fifteen Thousand only) with one solvent surety of the like amount, in Crime No.288 of 2022, registered by Police Station Sailu, District Parbhani, for the offences punishable under Sections 307, 341, 143, 147, 148, 149, 504 of the IPC, on the following conditions :

(a) The applicant shall attend the Police Station on every Sunday between 12.00 noon to 1.30 noon till filing of the charge sheet.

(b) He shall not tamper with the prosecution witnesses.
