Heard the learned counsel for the applicant and the learned A.P.P. for the respondent / State.

It has been alleged against the applicant that before the alleged incident the main accused had hired the present applicant to commit the murder pretending to be the motor vehicle accident. The prosecution has no case that the applicant was continuously in touch with the main accused to make the another killer available or hired again to commit the murder at the instance of main culprit. Only on the basis of previous attempt to commit murder, the applicant has been arrested. The allegation of conspiracy has been levelled against him. In view of the matter, there is no propriety in keeping the applicant behind bars. Hence, the following order :-

ii) Applicant Sajied Baig s/o. Ahmad Baig be released on bail, on furnishing PB and SB of Rs.25,000/- with one solvent surety of the like amount, in C.R.No.0120 of 2021 registered with Selu Police Station, District Parbhani, for the offences punishable under Sections 120B, 302, 201, 203, 427, 403, 465, 471 of the Indian Penal Code.
