The learned Counsel for the Petitioners submits that the Petitioners have moved an Application U/Sec. 267-A of the Maharashtra Zilla Parishads and Panchayat Samities Act before the Divisional Commissioner, Aurangabad on 28.06.2021 with regard to the cancellation of the work that was for the benefit of the Petitioners. Now, fresh Tenders are issued. The Divisional Commissioner has not passed any order.

The learned A.G.P. accepts notice for Respondents No. 1 to 3.

In case the Application is filed by the Petitioners (Page No. 31), and the same is pending before the Divisional Commissioner then, Divisional Commissioner shall take decision upon it preferably within a period of three (03) weeks. 4.

Writ Petition accordingly stands disposed of. No costs.
