The present second appeal is filed alongwith the delay condonation application. But during the pendency the parties have arrived at amicable settlement. As such, the delay condonation application i.e. Civil Application NO. 10173 of 2024 stands allowed in terms of prayer clause (B). IN SECOND APPEAL (ST) NO. 24514 OF 2024 WITH CA NO. 10174 OF 2024 :

The parties have already entered into compromise terms identified as "X". Those compromise terms vide order dated

(2) 3 CA-10173.2024.odt 19.09.2024 were referred to the learned Registrar (Judicial) of this Court for verification of the contents. Accordingly, Registrar (Judicial) submitted separate report dated 19.09.2024 mentioning that the parties have voluntarily entered into those compromise terms.

Therefore, the compromise terms identified as "X", are accepted and the appeal is disposed of in terms of those compromise terms. Decree be drawn in terms of those compromise terms.
