After hearing the matter and taking into consideration the status report, which has been submitted by the learned Additional Sessions Judge, Biloli that in view of transfer of the accused persons to another jail and non production of the accused before him, he could not take up the trial, in that event, certain directions can be given. Further, as regards the bail application is concerned, this Court is not inclined to grant any relief of releasing the applicant on bail, however, taking into consideration his age and the allegations, the learned Advocate appearing for the applicant agrees that if the matter is expedited, then it would be in the interest of justice. Therefore, taking into consideration all these aspects, following directions are given :- (1)

911-BA-1563-2020.odt (I) Application stands disposed of as withdrawn with direction to the learned Additional Sessions Judge, Biloli to try and dispose of Special (POCSO) Case No.09 of 2019 by the end of 31.08.2021. (II) The learned Additional Sessions Judge is directed to see that both the accused are kept at Biloli sub jail, if facility is there or with Nanded jail, till the end of the trial and he shall not permit the jail authorities to transfer the accused persons to any other jail during that period, thereby he should try the case expeditiously and decide it by the end of August, 2021 as per law. (III) Liberty is granted to the applicant to file bail application, if the trial does not over by the end of August, 2021. [SMT. VIBHA KANKANWADI, J.] scm (2)
