VERSUS

THE STATE ELECTION COMMISSION, THR. ITS COMMISSIONER AND OTHERS ....

Mr B. S. Deshmukh, Advocate for Petitioner;

Mr A. B. Kadethankar, Standing Counsel for Respondent No.1 Mr P. S. Patil, A.G.P. for Respondent Nos.2 to 5 CORAM : RAVINDRA V. GHUGE AND Y. G. KHOBRAGADE, JJ.

DATE : 22nd August, 2023 PER COURT:

1.

This matter was mentioned today at 10.30 a.m., praying for a simple direction that, the objections raised by the Petitioner to the provisional voters list, be decided. Hence, we listed this petition on the production board. 2.

By this petition, the Petitioner is seeking a direction to Respondent No.2, to delete 24 voters, whose names are published for the first time in the provisional voters list, dated 10/08/2023, since they are not residents of the village Savatkheda.

10460.23wp (2) 3.

The learned Standing Counsel representing the State Election Commission submits that, the programme for finalization of the voters list has been announced on 27/07/2023. A draft voters list was published on 10/08/2023. Objections to the draft voters list were sought in between 10/08/2023 to 21/08/2023. The Petitioner has lodged his objections. After considering the material, final voters list would be published on 25/08/2023. 4.

In addition, he submits that, for the Elections of the Village Panchayat, the voters list, as is published by the Election Commission of India for the State Assembly and the Loksabha Elections, is to be followed. If the Petitioner desires that, some of the voters should not be in the State Assembly Electoral Rolls or the Loksabha Constituency Electoral Rolls or at a particular place, he will have to approach the Election Commission of India by moving an appropriate online application.

5.

In view of the above, this petition is disposed off. (Y. G. KHOBRAGADE, J.) (RAVINDRA V. GHUGE, J.) sjk
