There is a consensus between the learned Counsel for the petitioner and the learned APP for the respondents that this petition can conveniently be disposed of with adirection to respondent no.2 to treat this petition itself as an application for grant of furlough and decide the same expeditiously.

In the light of the above, this petition is disposed of with a direction to respondent no.2 to treat this petition as an application of the petitioner for grant of furlough and decide the same on its own merits as expeditiously as possible, however, on or before 18.11.2016 and communicate the decision to the petitioner.

Since Mr.Londhe, learned Counsel is appointed as an amicus curiae to prosecute the cause of the petitioner, his fees be paid as per the schedule of fees maintained by the High Court Legal Services Sub-Committee, Aurangabad.
