Heard the learned counsel appearing for the applicant and the learned APP appearing for the respondent - State.

Perused the contents of the dying declaration and also the depositions of the prosecution

witnesses and in particular PW3 and also the medical evidence. We are of the prima facie opinion that, the findings recorded by the trial Court are in consonance with the evidence on record. We do not wish to elaborate on the evidence, since the Appeal filed by the applicant / appellant is pending for consideration.

For the reasons aforesaid, the application for bail stands rejected.

The Registry of this Court shall send original Record and Proceedings to the Registry of Additional Sessions Judge, Vaijapur. Upon receiving the original Record and Proceedings by the Registry of the Additional Sessions Judge, Vaijapur, the Registry of concerned Court shall prepare the paper book and send it back along with original Record and Proceedings, as expeditiously as possible, and preferably

within three months from receipt of the original record and proceedings.

After receipt of paper-book along with the original Record and Proceedings, liberty to mention for early hearing of the Appeal.
