The only reason of refusing the benefit of 2nd ACPS is that the petitioner did not produce the validity certificate.

The learned Advocate submits that the petitioner has been issued with the validity certificate.

The learned A.G.P. accepts notice for all the respondents.

In view of that, we pass the following order-

ORDER

(I) The petitioner may produce the validity certificate with the employer.

(II) The employer shall consider the issuance of validity certificate in favour of the petitioner and take decision afresh with regard to the 2nd ACPS benefit to be made available to the petitioner.

(III) While deciding the same afresh, the impugned order would not be an impediment.

Writ Petition accordingly stands disposed of. No costs.
