Learned Advocate for the applicant submits that while passing the order dated 03.03.2021 a statement was recorded in paragraph No. 3, which reads as under : "He is making a statement that the respondents No. 1 & 2 will not create any third party interest in the land Survey No. 359, 363, 551 admeasuring 66 Acres till the disposal of the Second Appeal No. 280 of 2009 with companion second appeal which is not renumbered as First Appeal No. 3069 of

He submits that now the respondent Nos. 1 to 4 have withdrawn the appeal filed before the Additional District Judge challenging the judgment and decree passed in Special Civil Suit No. 39 of 2010. In view of the same, he seeks to withdraw statement referred above. Learned Advocate for the respondents do not have any objection to the said. In view of the said the portion reproduced above stands deleted. by modifying the order dated 03.03.2021.
