Learned counsel submits that the proposal has been filed for start of higher Secondary School in the year 2008. The same is rejected without assigning specific reasons. According to the learned counsel, the order shows non-application of mind on the part of the authorities.

After the introduction of Right to Education Act, Ist to VIII standard are included in Primary. In light of that, the whole scenario would change. No purpose would be served by deciding the proposal for higher Secondary. The norms have undergone change.

In light of that, we pass the following order :

a) The Writ Petition is disposed of with liberty to the petitioner to file fresh proposal. In case such fresh proposal is filed and the same is permissible, the Respondent Authority shall consider the said proposal in accordance with law on its own merits. No costs. (A.I.S.CHEEMA,J.)
