The petitioner had filed an application at Exhibit 15 in Civil Miscellaneous Application No.43 of 2023, praying for re-issuance of notice to respondent no.1 in the said proceeding.

The learned District Judge-1, Bhoom allowed the said application. The said order is challenged in the present petition on the ground that there was no need to issue notice to respondent no.1.

The order was invited by the petitioner by filing application at Exhibit 15 and the order is an innocuous order which does not adversely affect any right of the petitioner.

Writ Petition is therefore dismissed.

At this stage, the learned Advocate for the petitioner seeks liberty to file application for deleting name of respondent no.1 in Miscellaneous Civil Application No.43 of 2023.
