The petitioner is aggrieved by the fact that inspite of Labour Court having decided the matter under Section 33-C (2) of the Industrial Disputes Act, 1947, the appropriate Government i.e. the Labour Commissioner is not taking further steps. 2.

The communication dated 06.03.2020 addressed by the Assistant Labour Commissioner to the petitioner clearly indicates that no requisition was received by him from the Labour Court as is contemplated under Section 33-C (4) of the Act. 3.

In view of such state of law, the learned Advocate for the petitioner seeks leave to withdraw the petition with liberty to

954wp14021.21 approach the Labour Court with a request to forward the decision to the Labour Commissioner.

The Writ Petition is dismissed as withdrawn with liberty as prayed for.

5.

If any such application is moved by the petitioner, the Labour Court shall consider and shall take urgent steps as is contemplated in law.
