Leave to add the Deputy Director, Education (Primary) Aurangabad as respondent No.5. Addition be carried out forthwith. The learned AGP causes an appearance on behalf of the added respondents.

2. The father of the petitioner passed away on 26.02.2022. He Moved an application on 08.03.2022 seeking appointment as a Clerk. The claim is still pending. He relies upon the GR dated 26.08.2021 for seeking compassionate appointment.

Considering the above, we permit the petitioner to lodge a representation with respondent No.5, on or before 15.12.2022. Thereafter, respondent No.5 would gather instructions and information from respondent No.4 / Education Officer (Primary), Zilla Parishad, Aurangabad and after taking into account the eligibility of the petitioner, GR dated 26.08.2021 and the availability of a vacant post, issue appropriate directions to the Education Society to enlist the petitioner in the list of eligible candidates for compassionate appointment. If the petitioner is eligible in all respects, respondent no.5 would ensure that respondent Nos.1 and 2 act in accordance with the directions of respondent no.4.

We make it clear that we have disposed off this petition without issuance of notice since we are not deciding the merits of the claim of the petitioner.
