Learned Counsel for petitioner fairly refers to that, an identical challenge had been posed to the provisions of Maharashtra Municipal Corporations Act, 2012, and Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 and that the same has been decided under decision of division Bench of this court dated 24.01./20.02.2014 in the case of Jaishri Vilasrao Khobe (Smt.) & ors Vs. State of Maharashtra & ors, reported in 2014 (3) Bom.C.R. 362. He further states that, the challenge to the provisions has failed. In the circumstances,
