The petitioner in person, who has been granted the certificate by the Committee of the learned Registrars to appear before the Court, seeks to challenge an order dated 10/05/2018 passed by the S.D.O. Aurangabad with regard to the mutation entry No.345 concerning Gat Nos.87 and 98 u/s 257 of the M.L.R. Code. 2.

The party in person relies upon an order passed by this Court at the Aurangabad Bench on 25/11/2016 in Criminal Writ Petition No.528/2014 wherein this petitioner was a party in person. khs/Sept. 2019/11576

I find that the petitioner has a statutory remedy of challenging the decision of the S.D.O. before the Additional Collector under Schedule E to Section 257 of the M.L.R.Code. Thereafter, he has a statutory remedy of approaching the Additional Divisional Commissioner and considering the judgment of the Hon'ble Apex Court in the matter of Gurudassing Nawoosing Panjwani Vs. State of Maharashtra [2015 (6) Mh.L.J. 915], a second revision before the State.

In view of the above, I do not find it appropriate to exercise jurisdiction in this matter. This petition is, therefore, disposed off. 5.

The petitioner is at liberty to approach the Additional Collector, Aurangabad for challenging the impugned order. The time spent by the petitioner in this Court from 23/07/2019 till the passing of this order, shall be a ground to be canvassed for condonation of delay, if any.
