Little over 50% of the amount in deposit has already been withdrawn. This is second application for withdrawal of the amount. Learned Advocate for the appellant - Insurance Company would submit that the vehicle has been falsely involved. The First Information Report had been lodged seven days after the accident. The driver has been charge-sheeted post the impugned award was passed. According to him, the appellant - Insurance Company has thus very good case in appeal.

In view of the aforesaid submissions, the application is rejected.
