PER COURT :- 1.

The present application is filed by Yogini, the wife of the deceased accused Nitin Tukaram Jadhav, who had deposited an amount of Rs.2,38,375/- as a condition imposed by this Court while granting anticipatory bail. The said amount has been deposited in the Court of the Chief Judicial Magistrate, Beed.

The learned Counsel for the applicant submits that 'A' summary is filed in respect of the accused Nitin Tukaram Jadhav and the same is accepted by the Trial Court. It is further submitted that, as such, there is no prosecution pending against the accused Nitin Tukaram Jadhav. 3.

Prayer clause 'B' of the application reads as under : - "B) By passing appropriate order or direction, applicant Yogini w/o Nitin Jadhav (wife of accused Nitin Tukaram Jadhav - deceased) may kindly be permitted to withdraw amount of Rs.2,38,375/- deposited by accused Nitin in the Court of Chief Judicial magistrate, Beed along with interest accrued thereon."
