Both sides are heard. Learned Government Pleader on instructions makes a statement that appeal filed by the Petitioner shall be assigned to the other officer and same shall be entertained and decided in accordance with law.

In view of above, impugned order is set aside. The appeal is relegated back to the Additional Divisional Commissioner for its decision in accordance with law. Also considering the fact that the issue is pending about reinstatement of the Petitioner for about over a period of year, Additional Divisional Commissioner to decide this appeal within a period of three months from today.
