After hearing the learned advocate for the petitioner and the learned AGP for Respondents No.1 and 2, a passover was sought by the learned AGP to take instructions.
After this matter is called out post-lunch, the learned AGP places on record a copy of the communication received by him, dated 29.08.2019, from the Private Secretary to the Hon'ble Minister, Rural Development, Women and Child Development, State of Maharashtra, that the pending proceedings shall be decided within four weeks. In view of the above, this petition is disposed off. The office of the Hon'ble Minister, Rural Development,
{2} wp1073319.odt Women and Child Development, State of Maharashtra, shall issue notice to Respondent No.5 - Maroti Prabhakar Kadam, informing him that the date of hearing in the matter would be posted on 19th September, 2019 at 12.00 noon. The petitioner need not be issued with notice as he has noted the said order today and shall suo motu appear at 12.00 noon on the said date in the chamber of the Hon'ble Minister in Mantralaya. The parties shall attend the hearing on the dates posted by the Hon'ble Minister and after the hearing is complete, the Hon'ble Minister would endeavour to pass an order on 04.10.2019. The litigating sides are obliged to remain present on 04.10.2019 in the chamber of the Hon'ble Minister. The copies of the order shall be kept ready to be supplied to the litigating sides on the same day.
In the event, a special meeting is convened for electing a new Sarpanch in the place of the petitioner, there would be liberty to the petitioner to request the Hon'ble Minister for an ad interim protection and such request shall be considered after hearing all the parties, on its own merits.
