Heard the learned counsel for the applicant, learned APP for the respondent-State and the Investigating Officer in person. 3.

The applicant seeks bail in Crime No.306 of 2024 registered with MIDC Police Station, Jalgaon, for the offence punishable under sections 406, 407 read with 34 of the Indian Penal Code. 4.

The applicant was a driver of a container in which the stolen yellow pulses were loaded. It has been alleged that instead of delivering the stolen goods to the distributor, he sold it in the black market. He was arrested. He supplied the information to the Investigating Officer to whom he had sold yellow pulses. The said person namely Gopal had tried to get the anticipatory bail but his bail application was rejected. Since then he was absconding. A few amount is recovered from three different persons. They are witnesses to the incident. Nothing is recovered from the applicant. Investigation is still

1644.2024BA.odt going on. He had antecedents of a murder case. However, it may not be a ground to refuse bail. No purpose would be served by keeping him behind bars. He deserves bail. Hence, the following order:

O R D E R

(i) Bail Application is allowed.

(ii) Applicant RAJASINGH @ RAJA AGNIDEVSINGH CHAUHAN be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, in the above crime, for the aforesaid offences, on the following conditions : (a) The applicant should not tamper with the prosecution witnesses.

(b) He should furnish his residential address, identity card and cell phone number with the Court as well Investigating Officer with an undertaking that he would not change it till the trial is concluded.

(c) He should attend the concerned Police Station Officer as and when called on written notice by the Investigating Officer, if required for further investigation.
