Heard learned counsel for the applicants and learned counsel appearing for the respondent acquiring body.

Learned counsel appearing for the applicants submits that the Land Acquisition Officer has awarded compensation at the rate of 670 per Are; whereas the Reference Court awarded

ca11658.17 compensation at the rate of 1395 per Are inclusive of amount of compensation already awarded by the Land Acquisition Officer. Therefore, it appears that the Land Acquisition Officer has enhanced the amount of compensation twice the compensation amount awarded by the Land Acquisition Officer. 3.

In view of above and the grounds stated in the application, I am of the opinion that at least 75 per cent of amount can be paid to the applicants. Hence, the applicants are permitted to withdraw 75 per cent amount of compensation and rest 25 per cent amount of compensation shall be invested in fixed deposit in any nationalized bank initially for a period of 13 months and thereafter the same be renewed from time to time till disposal of the appeal.
