Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant seeks bail in C.R.No.0269 of 2023 registered with Shahada Police Station, District Nandurbar, for the offences punishable under Sections 224, 353, 120B, 333 of the Indian Penal Code.

It has been alleged against the applicant that he had provided a vehicle to the co-accused to flee away from the custody of the police. The vehicle, in which the main accused was allegedly fled away, had no number plate. The accused has been arrested on the statement of the co-accused. A Scorpio car has rrd

907-BA-1520-23.odt been already seized from his house. After the incident, it was possible for the police to obstruct the vehicle used for fleeing away.

Be that as it may, the only role against the applicant/accused was that he had provided the vehicle to the coaccused to flee away. Nothing is to be recovered from him. He is languishing in jail since 18.05.2023. One of the co-accused, namely, Prakash is still absconding. Trial may take its time. No purpose would be served keeping the applicant behind bar. However, considering the nature of the offence and the residence of the applicant, few conditions may be imposed. Hence, the order:- i) The application is allowed.

ii) Applicant Narpat s/o. Gordhanram Jaat be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He shall attend the trial on each and every date material date unless beyond his control;

(b) He shall provide his and his family members cell phone numbers to the police with an undertaking that he could not change his cell phone number till conclusion of the trial;

(c) He shall submit his and his family member's Aadhar cards and certificate from the local body about his permanent address.
