For the reasons stated in the order passed on even date in Application For Leave to Appeal No. 118 of 2019, appeal is allowed subject to appellant paying cost of Rs. 10,000/- in the Trial Court.

Impugned order of acquittal dated 21.04.2018 passed by learned 19th Judicial Magistrate First Class, Aurangabad in S.C.C. No. 1435/2015 is quashed and set aside. 4.

The matter is remanded back to the Trial Court. The matter shall be proceeded from the stage, of further cross examination of the appellant.
