This is an application, under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "the BNSS"), for grant of regular bail in connection with Crime No.0119 of 2025, registered with Kallam Police Station, District Dharashiv, for the offences punishable punishable under Sections 103(1), 249 and 239 of the Bharatiya Nyaya Sanhita, 2023 (for short, "the BNS").
The learned counsel for the applicant pointed out the report in which the informant averred that the applicant committed murder of a woman. The applicant was driving the car as a driver.
Illicit relationships were developed between the applicant and the said woman. About two to three days prior to the incident, the said woman shown photographs and videos of their physical relationship, threatened to him and demanded Rs.5,00,000/-, otherwise threatened that she will lodge report against the applicant for commission of rape. She also threatened the applicant that earlier she had lodged such reports. Thereafter, a quarrel took place between them. Then she also pressurized the applicant by showing knife and compelled him to do exercise of 500 squatting. Thereafter, also a quarrel took place between them and in the heat of anger, the applicant assaulted the said woman with a hammer on her head and committed her murder. The learned counsel for the applicant submitted that the applicant is falsely implicated in the crime.
There is no eye-witness to the incident. Even if the prosecution's case is accepted as it is, the applicant has committed the said offence under the grave and sudden provocation. The learned counsel pointed out two reports lodged by the victim woman for commission of rape bearing Crime No.140 of 2022 and Crime No.09 of 2025, lodged with he same police station. Considering the conduct of the victim woman, the learned counsel for the applicant lastly prayed to allow the application, as the applicant has roots in the society and the trial will take a long period.
The learned APP for the State strongly opposed the application and submitted that the applicant has committed brutal murder of the victim woman by assaulting her with a hammer on her head and after eight days when the smell was spread, the incident of murder was revealed. The applicant is booked for serious crime of murder. Considering all these aspects, it is lastly prayed to reject the application.
Perused the charge-sheet, particularly, the report and the statements of witnesses.
The applicant has no criminal antecedents. He has roots in the society and he will not flee away from the trial. The trial will take a long period. Considering the above reasons and the entire chargesheet as well as the facts and circumstances of the case, particularly the fact that the victim woman had earlier lodged two reports, as pointed out by the learned counsel for the applicant, the application deserves to be allowed on the principle that bail is rule and jail is exception, on certain conditions. Hence, the following order:-

The application is allowed.
II.
The applicant in connection with Crime No.0119 of 2025, registered with Kallam Police Station, District Dharashiv, for the offences punishable punishable under Sections 103(1), 249 and 239 of the Bharatiya Nyaya Sanhita, be released on bail on furnishing personal bond of Rs.50,000/- with surety of the like amount on following conditions:- a) The applicant shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner.
