Despite service of Court notice, the contesting respondent No.4, which is the acquiring authority, has not caused an appearance in this matter. It has to forward a proposal to respondent No.2.

We find from the record that the land of the petitioner in Gut No.403/1, situated at Mouje Bensur, Tq. Patoda, Dist. Beed, has been acquired to the extent of 59 Are, for the construction of the Bensur Percolation Tank No.2. The Tank is already constructed in 2002. No compensation has been paid to the petitioner.

In view of the above, this petition is disposed off with the following directions :- (a) Respondent No.4 shall forward the proposal for acquisition of 59 Are land of the petitioner, in land Gut No.403/1, at Mouje Bensur, on or before 30/07/2022. (b) After receiving the said proposal, the District Collector, Beed, shall initiate appropriate proceedings, in accordance with the scheme laid down in the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

(c) The award shall be delivered, on or before 30/06/2023 and the amount of compensation would be paid to the petitioner, expeditiously.
