IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 187 WRIT PETITION NO.10361 OF 2022 YOGESH BHAUSAHEB PAWAR
VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS ...
Advocate for Petitioner : Mr. Venjane Tukaram M. AGP for Respondents: Mr. S.G. Karlekar .....
CORAM : RAVINDRA V. GHUGE AND SANJAY A. DESHMUKH, JJ.
DATED : 13th OCTOBER, 2022.
PER COURT :- 1.
The petitioner has challenged the show cause notice dated 09.09.2022 issued by the Tahsildar, respondent No.4. 2.
Reliance is placed upon the judgment delivered by this court at Nagpur Bench, dated 25.3.2022 in writ petition No. 1579 of 2022, filed by Sumit Hargovind Lanje vs. The State of Maharashtra and others. A similar order passed by the learned Single Bench of this court dated 25.08.2022 in writ petition No. 8194 of 2022 filed by Vishal Laxman Shinde vs State of Maharashtra and others, is cited.
3.
This petition is disposed off.
wp10361.22 -24.
The petitioner has already submitted a detailed explanation before respondent No.4, dated 16.09.2022, alongwith case law. We therefore, expect, respondent No.4 to consider each and every objection of the petitioner and more particularly in the light of the judgments, that have been cited, concluding that said show cause notice is without jurisdiction, and pass a reasoned order on or before 15.11.2022.
5.
In the event the petitioner is aggrieved by the order passed, he would be at liberty to approach the appropriate forum for challenging the same.
