IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 920 WRIT PETITION NO. 1522 OF 2025 Sukhdeo Laxman Lokare Died Thr Lrs Bibishan Sukhdeo Lokare

VERSUS

The Deputy Collector Land Reform And Others ...

Mr.Dhananjay A. Mane, Advocate for the Petitioner. AGP for Respondent-State.

CORAM : KISHORE C. SANT, J.

DATE : 31st JANUARY 2025 PC :- 1.

Petition is directed against the order dated 8th August 2024 passed by the learned President, Maharashtra Revenue Tribunal, Mumbai, Bench at Pune which reads as under:- "Heard on stay application.

Stay granted in terms of prayer clause "21B" of stay application till next date. Parties to maintain status quo till next date." 2.

By reading the order, it is only that the parties are directed to maintain status quo till the next date i.e. till 25th October 2024. 3.

Today, the learned Advocate tried to convince before this Court that the respondents are taking disadvantage of the impugned order.

Ethape ( 2 ) 920 -WP-1522-2025 Now even the suit is filed before the Civil Court and therefore, directions are necessary to be given to the Civil Court to decide Exhibit-5 Application within stipulated period.

4.

This Court hardly finds any reason to interfere with the order as the impugned order is only granting ad-interim relief for a particular period. All the more now that period is also over. Merely because, the parties likely to have taken subsequent steps pursuant to the impugned order is no reason to entertain the writ petition. 5.

In view of the above, this Court is not inclined to interfere with the impugned order.

6.

Writ Petition stands dismissed.

7.

The petitioner is at liberty to prosecute the remedy available under the law.
