Learned advocate for the applicant undertakes to remove office office objections, if any.

By this application filed under section 439 (2) of the Code of Criminal Procedure, the applicant / original informant seeks cancellation of bail granted to respondent No.2 by the Sessions Court in Crime No. 181 of 2018 registered with Vedant Nagar Police Station, Aurangabad for the offences punishable under sections 420, 465, 468, 471 of the Indian Penal Code.

Heard the learned advocate for the applicant, learned Additional Public Prosecutor for respondent No.1 - State and learned advocate for respondent No.2. Perused the investigation papers.

FIR is lodged in the year 2018. Investigation in the said crime is complete, and charge-sheet came to be filed on 01/10/2020, and the case is numbered as RCC No. 2531 of 2021. Before the trial Court, matter is kept on 20/01/2023 for appearance of the accused.

Considering these subsequent developments, and filing of charge-sheet, it is not desirable to accept the request of applicant to cancel anticipatory bail granted to respondent No.2 on 29/11/2018.

Application is, therefore, dismissed.
