The FIR was registered on 14-12-2020 at Sadar BazaarPolice Station, Dist. Jalna vide Crime No.780 of 2020 for offences under Sections 406 and 420 read with Section 34 of the IPC. 2.

The case of the complainant is that he was appointed as a Manager in Vyankatesh Multi State Co-operative Society, Limited, Ahmednagar, branch Jalna. The applicant and other persons were interested in working with cooperative credit society and they were appointed as representatives in respect to the daily service and they were supposed to collect money from the depositors. It is alleged that, now it was realised that there was misappropriation of Rs.57,200/- by the applicant. The contention of the applicant is that he was working in the credit society in the year 2016-2017. He resigned from the said cooperative society in the year 2017. There were irregularity in the work

of the cooperative credit society and now without any reason it is alleged that the applicant has misappropriated the amount in the year 2015-2016.

The learned APP submits that the applicant is involved in misappropriation of the amount. Specific role has been attributed to him. Custody is required to recover the amount. 4.

First information report indicates that the applicant has allegedly misappropriated Rs.57,200/-. The transaction is of 2016-17. 5.

Learned counsel for the applicant, on instructions, submits that the applicant would deposit Rs.57,000/- within a period of six weeks from today in this Court. The statement is accepted. 6.

In view of the above, relief can be granted to the applicant. Hence, I pass the following order :-

O R D E R

i.

Anticipatory Bail Application No. 1263 of 2021 is allowed; ii.

In the event of arrest of the applicants in Crime No.780 of 2020, registered with Sadar Bazaar Police Station, Dist. Jalna, he be released on bail on executing P.R. bond in the sum of Rs.25,000/-, with one or more sureties in the like amount.

iii.

The applicant shall deposit an amount of Rs. 57,000/- in this Court within a period of six weeks from today. In the event the amount is not deposited, the prosecution will be at liberty to prefer an application for cancellation of the anticipatory bail. iv.

In the event the amount is deposited in this Court, the said amount be transferred to trial court, if charge sheet is filed against the applicant and the trial court shall deal with the said deposit at appropriate stage.
