The learned counsel for the petitioners submits that the petitioners have filed application under Section 5 of the Mamlatdars' Courts Act, 1906 (hereinafter referred to as ' Act of 1906') for removal of obstruction from the road bearing Rasta Case No. 211/2015. Since the year 2015, the same is not decided.

In case, there is no other impediment, then the respondent/authority before whom the proceedings filed by the petitioners under Section 5 of the Act of 1906 may be pending shall decide the same after hearing all parties concerned and adhering to the procedure laid under the Act of 1906 expeditiously and preferably

Writ petition is disposed of. No costs.
