1] The applicant is apprehending arrest in connection with Crime No. 1023 of 2023, registered at Shirdi Police Station, Taluka Rahata, District Ahmednagar, for the offences punishable under sections 307, 323, 504, 506 r/w. 34 of the Indian Penal Code.

2] The learned counsel for the applicant submits that the injury has been caused by the main accused on the neck and the applicant has not caused any injury, as such, the applicant be released on anticipatory bail. 3] The learned APP submits that custodial interrogation of the applicant is necessary in the matter as

1534.24ABA he held the neck of the victim and stretched the injury caused by the co-accused.

4] Considering that the injury caused is by sharp weapon on the neck of the complainant and the injury is on the vital part of the complainant and that prima facie the applicant along with other accused was directly involved in the alleged crime, the custodial interrogation of the applicant is necessary in the matter. As such, no case is made out for grant of anticipatory bail in favour of the applicant. Hence, the present application is dismissed. [ARUN R. PEDNEKER] JUDGE DDC
