1] By order dated 4th January, 2024, this Court had noticed that the respondent is served through his father. 2] The learned counsel for the applicant submits that the respondent is also served by private mode. The learned counsel for the applicant has tendered across the bar a copy of track report and the same is taken on record. 3] Though the respondent is served, none has entered appearance on behalf of the respondent. 4] The present Application is filed seeking transfer the proceedings bearing P.A.No.1119 of 2023 from the Judge, Family Court No.2, Pune to Principal Judge, Family Court at Latur.

233.23MCA 5] It is the case of the applicant that the marriage between the applicant and respondent was solemnized on 22.05.2017 and that the applicant has one daughter out of the wedlock and the daughter is staying with the applicant. The applicant and her daughter are residing with her parents. The applicant has no independent source of income. The respondent is doing a business as Graphic Designer at Pune. The financial condition of the respondent is sound, therefore, he can conduct the proceedings at Latur. Considering the said fact, the present Misc. Civil Application may be allowed.

6] In view of the submissions made,the present Misc. Civil Application is allowed in terms of prayer clause-B, which reads as under :

B) The proceedings bearing P.A.No. 1119 of 2023 may kindly be transferred from the file of Judge, Family Court No.2, Pune to the Court of Principal Judge, [Family Court], appropriate court at Latur;

7] The present application is disposed of accordingly.
