Order :-
1. Mr. Nagarkar, learned counsel for petitioner submits that in view of provisions of sections 40 and 48 of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971, as a matter of fact, criminal writ petition ought to have been filed, however, the petitioner hitherto had been prosecuting writ petition of civil nature. He, therefore, requests for conversion of civil writ petition into criminal writ petition.

As such, conversion as sought is allowed subject to risk and peril of petitioner.
