Heard learned counsel for the applicants and the insurance company.

Considering the defense raised by the insurance company in the appeal, permission is granted to the applicant to withdraw 50 per cent amount of the compensation deposited in this appeal with proportionate accrued interest thereon till the date of withdrawal, subject to filing of written undertaking within a period of six weeks from the date of passing of this order to deposit the withdrawn amount as and

ca12766.18 when directed by this Court. Remaining amount shall be invested in the fixed deposit in any Nationalized Bank till final disposal of the appeal. Apportionment shall be as per the award passed by the Tribunal.
