The applicant/wife seeks transfer of H.M.P.A. No.4 of 2023 pending before Family Court, Beed to Civil Judge, Senior Division, Rajguru Nagar, Pune.

Learned advocate appearing for applicant submits that applicant is a lady and cannot undertake journey of about 300 kms to attend the proceeding pending at Family Court, Beed. According to him, applicant would be suffering great inconvenience in attending proceeding at Beed to lead her evidence.

Learned advocate appearing for respondent/husband strongly opposed the application and offers to bear traveling expenses.

Having considered submissions advanced, it can be observed that the distance between the place of residence of applicant and Family Court at Beed is 275 kms. Apart from that, applicant has

41-mca-323-2023.odt (2) instituted proceeding vide H.M.P. No.432 of 2023 before District Judge, Pune. In these circumstances, there would be no difficulty for husband to attend the proceeding at Rajguru Nagar, Pune, if transferred. Considering convenience of wife which is to be given precedence over convenience of husband, this Court deems it proper to allow the application.

In result, application is allowed in terms of prayer clause (B).
