In both these cases, the FIR registered against the Petitioners indicates that proxy candidates appeared for the exams in place of these two Petitioners. Same is stated in the FIR as dummy candidate appeared on behalf of these Petitioners.

In view of the above, the learned advocate for the Petitioners submits that the Petitioners desire to withdraw this petition. If they are acquitted or if a '

summary report is submitted or if the FIR is quashed under the orders of this Court, they would renew their request for considering them for recruitment since they are in the merit list and the Respondent-MHADA has stated in paragraph 10 and 11 that posts will be created to accommodate such candidates only after they are acquitted.

In view of the above statement, these two petitions are disposed off with liberty.
