Application filed by the petitioner for appointment of court commissioner is rejected by the Trial Court. 2.

Admittedly, the evidence of petitioner/plaintiff is being recorded. Hence, the application for appointment of Court Commissioner is filed at pre-mature stage and therefore, this Court is not inclined to interfere in the order impugned in the present petition at this stage. Writ petition is therefore dismissed with liberty to the petitioner to file application for appointment of court commissioner after conclusion of recording of evidence. If such application is filed at that stage, Trial Court shall consider the same on its own merits without being influenced by the order impugned in the present petition.
