1] The application for assist to public prosecutor is allowed.
2 15 2] Heard learned counsel for the applicants, learned APP for the respondent-State and the learned counsel for the assist to public prosecutor.
3] The applicants are apprehending arrest in connection with Crime No.414 of 2024, registered at Akole Police Station, District Ahmednagar, for the offences punishable under sections 326(g), 332(c), 324(2), 324(6), 189(1), 189(2), 191(2), 191(3), 190 of the BNS.
4] The learned counsel for the applicants, on instructions, seeks leave to withdraw the application qua applicants no.1, 2, 3, 5 and 6.
5] Leave granted. The anticipatory bail application stands dismissed as withdrawn qua applicants no.1, 2, 3, 5 and 6, except applicant no.4 - Satish Macchindra Pawar.
6] Having heard the learned counsel for the parties and the learned APP for the State, it appears that the name of the Satish is not entered into the FIR, so also, not taken by the person, who has recorded the video, so also, by any of the witnesses. 7] In view of the above, the application is allowed qua applicant no.4 - Satish Macchindra Pawar in the following terms : i] In the event applicant no. 4 - Satish Macchindra Pawar is arrested in connection with Crime No.414 of 2024, registered at Akole Police Station, District Ahmednagar, for the offences
3 15 punishable under sections 326(g), 332(c), 324(2), 324(6), 189(1), 189(2), 191(2), 191(3), 190 of the BNS, he shall be released on bail on furnishing PR bond of Rs.15,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.
ii] Applicant no. 4 - Satish Macchindra Pawar shall attend the police station as and when required by the Investigating Officer. iii] Applicant no. 4 - Satish Macchindra Pawar shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case.
iv] Applicant no. 4 - Satish Macchindra Pawar shall co-operate with the investigation and also in the proceedings before the trial Court.
8] In the event, applicant no. 4 - Satish Macchindra Pawar violates any of the conditions specified in this order, it shall be liable to be cancelled.
9] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 10] The application stands disposed of.
