Heard learned Advocate Shri. M.G. Deokate for the appellants. As per the amendment under the Maharashtra Civil Courts Act published on 29th July, 2015, all appeals in which value of the subject matter does not exceed Rs. one crore pending before the High Court, are required to be transferred to the concerned District Court, which shall have a jurisdiction to decide the same. In the present case, the valuation is Rs. 66,50,000/-.

The office has placed note sheet that matter is required to be transferred. The learned Advocate for the respondent agrees. In view of the amendment under section 28 (c), the appeal is transferred to the Court of District Judge,Jalna for trial according to law.

Learned Advocate Shri. K.D. Jadhav appearing for the respondent and the learned Advocate Shri. Deokate assures to keep parties present in the District Court, Jalna. 4.

The matter is placed on 27th August, 2018.

Registrar (Judicial) to transfer all the papers to the District Court, Jalna at the earliest.

The Appeal stands disposed of as far as this Court is concerned.
